1. Introduction
Welcome to FirstArive Immigrants (“Platform”), operated by FirstArive LLC, a Massachusetts-registered company (“FirstArive,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of our Platform, including websites, mobile applications, digital tools, AI features, events, and services offered through or in connection with FirstArive Immigrants.

By accessing, registering, or using the Platform, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.

2. Purpose of the Platform
FirstArive Immigrants connects newcomers and immigrants with hosts, events, resources, and local services to support community integration. Users can join as members (free or paid), host or attend events (free or paid), participate in a community marketplace, and access AI-powered resources and partner benefits.

FirstArive acts solely as a facilitating platform and is not a party to any user-to-user or user-to-vendor transaction.

3. Eligibility and Account Responsibility
You must be at least 18 years old or the legal age of majority in your jurisdiction. You agree to provide accurate and complete information, maintain the confidentiality of your credentials, and be fully responsible for all activities under your account. We reserve the right to suspend or terminate accounts for any violation of these Terms or suspicious activity.

4. Memberships, Subscriptions, and Payments
The Platform offers multiple tiers (Free, Thrive, Thrive Gold, Thrive Elite), each with defined benefits. Payments are processed securely through approved third-party payment gateways (e.g., PayPal, Stripe).

By providing payment details, you authorize recurring charges unless you cancel. Refunds are subject to our Refund Policy. Users are responsible for any taxes arising from transactions or events they organize or attend.

5. Events, Marketplace, and User-Generated Content
Hosts are solely responsible for event accuracy, safety, and compliance with laws, including local permits, venue rules, and legal work authorization requirements. Attendees assume all risks related to participation.

Marketplace listings must be lawful and truthful.

FirstArive is not responsible for ensuring that hosts or participants have proper work authorization or legal eligibility to receive income from paid events or marketplace transactions. Users posting paid events acknowledge that they are personally responsible for compliance with all immigration, tax, and employment laws.

FirstArive does not guarantee the safety, quality, or fulfillment of any event, service, or transaction. By posting or uploading content, users grant FirstArive a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content for Platform operation and marketing purposes.

6. Cybersecurity and Data Protection
We implement reasonable administrative, technical, and physical safeguards to protect user data, including encryption, firewalls, and controlled access. However, no system is fully secure.

By using the Platform, you acknowledge that data transmission carries inherent risks. Users agree not to breach security, introduce malware, or interfere with Platform operations.

7. Artificial Intelligence Tools
The Platform includes AI-powered chat and recommendation tools (“FirstArive AI”). These tools provide general guidance only and do not constitute legal, financial, or medical advice. Outputs are informational and must be independently verified. FirstArive assumes no liability for actions taken based on AI-generated content.

8. Acceptable Use Policy
You agree not to use the Platform for illegal, fraudulent, or harmful activities, to harass others, or to post unlawful content. Violation may lead to immediate suspension and reporting to law enforcement.

9. Intellectual Property Rights
All intellectual property (logos, graphics, software, and databases) is owned by FirstArive LLC or its licensors. Unauthorized reproduction, sale, or modification is prohibited.

10. Third-Party Links and Integrations
The Platform may integrate with third-party services (e.g., Uber, Google Maps, PayPal). These are governed by their own terms. FirstArive is not responsible for the content, availability, or security of external sites.

11. Limitation of Liability
The Platform is provided “as is” and “as available.” FirstArive disclaims all warranties, express or implied.

To the fullest extent permitted by law, FirstArive shall not be liable for indirect, incidental, or consequential damages.

Liability shall not exceed the total amount paid by the user in the past 12 months.

12. Indemnification
You agree to defend and hold harmless FirstArive LLC, its affiliates, and partners from any claims or expenses arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

13. Privacy and Data Usage
Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to data collection and processing in accordance with applicable laws including GDPR and CCPA.

14. Suspension and Termination
We may suspend or terminate your account for violation of these Terms, fraudulent activity, or legal obligations. Upon termination, your right to use the Platform ceases immediately.

15. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts. Any dispute shall be resolved exclusively in Middlesex County, MA. Users waive any right to class-action proceedings.

16. Updates and Modifications
We may modify these Terms at any time. Continued use after posting constitutes acceptance of updates.

   Payments on the Platform are processed by secure third-party gateways such as PayPal or Stripe.
   FirstArive does not store full credit card numbers or banking details on its servers.
   Users posting paid events are solely responsible for ensuring compliance with applicable tax, employment, and work authorization laws.
   FirstArive does not assume liability for users’ legal status or income eligibility in their jurisdiction.
8. Cookies and Tracking Technologies
   We use cookies and similar technologies to:
   • Keep you signed in
   • Personalize your experience
   • Analyze site traffic and performance
